Service – the online platform operating under the domain www.sm-production.com

Client – a natural person with full legal capacity, and in cases provided for by generally applicable laws, also a natural person with limited legal capacity or a legal entity or an organizational unit without legal personality, which the law grants legal capacity – who has concluded or intends to conclude an Agreement with SM PRODUCTION Sp. z o.o. or uses or intends to use at least one Service or Electronic Service;

Product – a movable item available on the Service that is the subject of the sales agreement between the Client and SM PRODUCTION Sp. z o.o.;

Service – a paid, non-material functionality available on the Service that is the subject of an Agreement between the Client and SM PRODUCTION Sp. z o.o.;

Agreement – an agreement for the provision of a Service concluded or entered into between the Client and SM PRODUCTION Sp. z o.o. via the Service or another type of agreement specified individually in the Terms and Conditions;

Electronic Service – a service provided electronically by SM PRODUCTION Sp. z o.o. to the Client via the Service;

DATA CONTROLLER

The data controller within the meaning of the Regulation of the European Parliament and Council (EU) of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: the Regulation) is SM PRODUCTION Sp. z o.o.

PURPOSE AND SCOPE OF DATA COLLECTION

During the presence of the user or Client on the Service, particularly when using Electronic Services or purchasing a Product or service made available by SM PRODUCTION Sp. z o.o. on the Service, or using Electronic Services, they may be asked to provide (disclose) their personal data. The scope of providing their data to SM PRODUCTION Sp. z o.o. is divided into mandatory and optional data, each time specified in the form adapted for entering this data, according to the needs of the particular Product, Service, or Electronic Service that the user or Client intends to use. Providing data is always voluntary but sometimes necessary for the proper execution of the order or Electronic Service.

Data processing is carried out solely for the purpose for which it was disclosed to SM PRODUCTION Sp. z o.o. Data processing for marketing purposes is carried out only after obtaining separate consent from the user or Client of the Service. Data processing for the purpose of sending commercial information is carried out only after obtaining separate consent from the user or Client of the Service.

The purpose of the Privacy and Security Policy is to define the actions taken by SM PRODUCTION Sp. z o.o. in the field of protection of personal data processed, including data collected via the Service, such as registration, placing orders, recording data on servers, and all other identical activities related to data processing when using the Service. All actions of SM PRODUCTION Sp. z o.o. are subject to the provisions of Polish law and the General Data Protection Regulation (Regulation). The Privacy and Security Policy is subject to the provisions of Polish law and the General Data Protection Regulation (Regulation).

DURATION OF PERSONAL DATA PROCESSING

The data of the Service Client will be processed for the duration of the agreement for the provision of the Electronic Service and up to 30 days from the termination of the agreement for the provision of the Electronic Service, and in the case of a concluded Agreement for the period of execution of this agreement and for up to 10 years from its completion or from the withdrawal from the Agreement.

VOLUNTARINESS OF PROVIDING DATA

Each user or Client of the Service, in order to use Electronic Services or place an order, has the right to voluntarily provide data. In the case of using certain services, including during the ordering process, providing data, although voluntary, may prove necessary for the execution of the Electronic Service or order.

The necessary (mandatory) data to be entered in the case of using the Electronic Service or executing the order are always specified in the form intended for entering this data.

RIGHT TO ACCESS DATA

Each user or Client of the Service has the right to access data and correct it, particularly through access to the Client Panel or by contacting SM PRODUCTION Sp. z o.o.

In case of contact with SM PRODUCTION Sp. z o.o., for security reasons, your identity will be verified.

RIGHT TO DELETE DATA

Respecting the rights of users and Clients of SM PRODUCTION Sp. z o.o., we would like to inform you that every person has the right to delete their data. This right is commonly referred to as the „right to be forgotten”. SM PRODUCTION Sp. z o.o. is obliged to delete all data of the requesting person, provided that there is no other legal basis for further processing of this data, such a basis may arise, for example, from the obligation to store financial documentation. However, if the realization of the request is not possible, we will inform you of this along with the legal basis.

RIGHT TO DATA PORTABILITY

Upon explicit request of the person whose data is processed by SM PRODUCTION Sp. z o.o., you will receive from us a file with structured data in a commonly used format. Under this right, you can also indicate the entity to which we, as the data controller, should send your data.

The realization of this right may take up to 30 days. At the same time, for security reasons, we will verify your identity to ensure that your data goes to the correct person.

SECURITY AND PROTECTION OF PERSONAL DATA

SM PRODUCTION Sp. z o.o. declares that it processes personal data of users and Clients of the Service in accordance with the Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and that it applies technical and organizational measures ensuring the protection of processed data appropriate to the threats and the category of data under protection, and in particular, it secures personal data of users and Clients of the Service against unauthorized access, loss, or damage.

COOKIES

Cookies are understood as IT data, particularly short text files, stored by the web browser or directly on the end devices of users intended for the use of websites. These files allow recognizing the user’s device and appropriately displaying the website adapted to their individual preferences. Cookies usually contain the name of the website from which they originate, the time of their storage on the end device, and a unique number.

Cookies are used for the following purposes:

– creating statistics that help understand how users use the Service, which directly affects the improvement of their structure and content;

– maintaining the session of the Service user, thanks to which they do not have to re-enter the login and password or perform additional actions, e.g., re-adding a product to the cart on each subpage of the Service;

– defining the user’s profile to display them tailored materials in advertising networks, particularly the Google network.

Within the Service, two main types of cookies are used: „session” (session cookies) and „persistent” (persistent cookies). „Session” cookies are temporary files that are stored on the user’s end device until logging out, leaving the Service, or turning off the software (web browser). „Persistent” cookies are stored on the user’s end device for the time specified in the cookie parameters or until manually deleted by the user.

 

Web browsing software (web browser) usually by default allows the storage of cookies on the user’s end device. Users of the Service can change the settings in this regard. BLOCKING OR DELETING COOKIES

According to the applicable provisions of the Act of July 16, 2004 Telecommunications Law (Journal of Laws 2004 No. 171, item 1800 as amended), particularly Article 173 paragraph 2, the user has the right to decide on the access of cookies to their end device by setting the appropriate settings (rights) for these files in the settings window of their web browser.

 

Leaving the software settings unchanged installed on the end device means consenting to placing text-type cookies on the user’s device.

SERVER LOGS

Information about some user actions is subject to logging at the server level. These data are used only for the purpose of administering the Service. The resources browsed are identified by URL addresses. Additionally, the following may be recorded:

– the time of arrival of the request;

– the time of sending the response;

– the name of the user’s station – identification carried out by the HTTP protocol;

– information about errors that occurred during the execution of the HTTP transaction;

– the URL address of the page previously visited by the user (referer link) – if the transition to the Service occurred through a link;

– information about the user’s browser;

– information about the user’s IP address.

The above data are not associated with specific persons browsing the pages. The above data are used only for the purpose of administering the Service.

DISCLAIMER OF LIABILITY

The Privacy and Security Policy does not include information concerning the services, goods, or websites of third parties made available in the Service as part of agreements with other entities. Third parties independently and on their own responsibility define separate, individual rules for the functioning of their services, goods, or websites in their regulations.
